KITTY COTTAGE ADOPTION CENTER, INC.
ADOPTION AGREEMENT FOR HOUSE CAT
Kitty Cottage Adoption Center, Inc. (the "Charity/we/us"),
a Pennsylvania non-profit corporation, and the undersigned
(the "Adopter" or "you"), in consideration of the mutual promises
and other good and valuable consideration in this Agreement,
intending to be legally bound, agree to the following:
1. The Cat. We are placing the following described
cat with you, the Adopter, for adoption by you as an indoor
house cat (the "Cat"):
Male Female Name _________________________
Charity's name
Prior owner's name
Color/Markings/Breed/Mix _________________________________________________________
Distinguishing Characteristic(s) _____________________________________________________
Approximate age ____________
Spay/Neuter Date _______________
Rabies _______________
FVRCP (distemper) ____________
Anti-parasitic ___________
De-worming (if any) ___________
Other vaccinations (if any) _________________________________________________________
Leukemia/FIV test results _______________
Other _____________________________________
2. Sterilization. In the unlikely event that
the Cat has not been spayed or neutered prior to this adoption
because of medical reasons, you agree to enter into a Sterilization
Agreement with us simultaneously with this Agreement, pay
a security deposit, and have the Cat sterilized in accordance
with the terms and conditions of the Sterilization Agreement.
3. Adoption Fee. We require an adoption fee
of $ 80.00 for the Cat. We require a $20.00 deposit at the
time you make your application. Any donation you can make
in addition to the adoption fee would be greatly appreciated.
The adoption fee is not refundable, except if the Cat dies
within six weeks of its adoption, or you return the Cat to
us within three weeks of its adoption.
4. No Representations. You understand that this
Cat was previously unwanted or lost and may have been rescued
from a dangerous, unhealthy and/or cruel situation. This could
result in the Cat's emotional or physical illness. You agree
that we are making no representations or warranties about
the temperament, personality or condition of the Cat.
5. Care of the Cat. You agree to provide to
the Cat every day, free run of your house, fresh water, wholesome
cat food, a clean litter box, and affection. You agree to
keep the cat for its whole life. For health and safety reasons,
we strongly discourage you from allowing the Cat outdoors.
Cats that do not go outdoors have been shown to live significantly
longer and healthier lives.
6. Veterinary Care. You agree to have the Cat
examined by a licensed veterinarian about one month after
adoption, but if the cat has not had its distemper booster
vaccination, it should be seen by a vet by the due date for
the booster. You will have the cat examined by a veterinarian
not less than yearly thereafter. In case of illness or injury,
you agree to seek prompt veterinary care. You agree to keep
rabies and distemper vaccinations current.
7. Declawing Strongly Discouraged. We strongly
discourage you from having the Cat declawed. Declawing is
the painful amputation of the claw and first knuckle of a
cat's toes. Charity and many other animal welfare organizations
are of the opinion that declawing is a cruel and inhumane
practice.
8. No Transfers of Cat; Returning a Cat; Euthanasia.
You agree not to abandon, give away, sell, or dispose of the
Cat in any way, except to another person you have personally
evaluated, who wants to adopt the Cat as a house cat, and
who will provide the same care for the Cat, as you are required
to provide under this Agreement. Please contact us at that
time for a form of adoption agreement you can use with the
new owner. If you determine you no longer want to, or no longer
can keep the Cat, and you can not find a good, permanent home
as described above, you may make an appointment to return
the Cat to us, and we will try to arrange another adoption.
You will not ask a veterinarian to euthanize the Cat, except
in the case of terminal illness or massive injury.
9. Lost Cat. You agree to make a serious effort
to find the Cat if it becomes lost, by immediately (a) conducting
a detailed physical search of your yard and your neighbors'
yards, (b) setting humane traps in your yard to catch the
Cat, (c) filing lost reports with the local police, animal
control authorities, animal shelters, SPCA's, and local veterinarians,
(d) posting lost cat signs, and (e) contacting us for additional
advice. Escaped cats usually hide, don't meow, and won't respond
to your calls, so you must search thoroughly high and low.
10. Breach of Agreement; Liquidated Damages.
In the event that you do not comply with the terms of this
Agreement or the Cat is abused or neglected, one of our remedies
will be to recover the Cat from you upon demand. Promptly
after the demand you will come to our adoption center, or
we will come to your home, and you will surrender the Cat
to us immediately. In addition, without waiving any of our
rights under this Agreement, if you do not surrender the Cat
to us, you will owe us a payment in the amount of Five Hundred
Dollars ($500.00), agreed between us as just and reasonable
liquidated damages to compensate us for our costs and expenses
in connection with your breach of this Agreement.
11. No Liability. The Charity is not liable
to you or any other party for any losses, injuries, damages,
costs, expenses, liabilities, lawsuits or judgments whatsoever
in connection with your adoption or ownership of the Cat.
12. Entire Agreement; Modification; Binding
Effect. This Agreement is the entire agreement between us
and you, and supersedes any prior understandings between us
and you with respect to the subject matter hereof. No modification
of this Agreement will be valid unless in writing duly signed
by both us and you. This Agreement is binding on our and your
successors, heirs, assigns, executors and personal representatives.
